Qu’est ce qu’un ABN, Australian Business Number ?

Il s’agit d’un numéro commercial d’identification, un Business Number qui vous permet d’évoluer sur le marché du travail australien, en tant qu’indépendant. C’est un statut de base, un statut d’entrepreneur indépendant qui vous permettra d’entrer en contrat avec les très nombreuses petites et moyennes sociétés et entreprises qui composent le secteur professionnel dans chaque Etat :

  • Les secteurs de la construction
  • La manutention
  • Le nettoyage industriel et particulier
  • Le secteur de la livraison
  • Le secteur du bâtiment
  • La sécurité
  • Emplois occasionnels ou à temps partiel

Pour les étudiants internationaux être titulaire d’un ABN est important, vous aurez plus de choix et plus d’opportunités. N’oubliez pas cependant que votre visa étudiant vous limite et ne pouvez travailler que 40 heures par quinzaine en période scolaire.


 

Le statut d’entrepreneur indépendant

Il s’agit le la forme de société la plus simple. Le coût lie a la mise en place de ce statut de : Sole Trader est minimal et les formalités fiscales et légales sont peu compliquées. Le « business » vous appartient et vous êtes le seul à le diriger et le manager. Vous en êtes aussi le responsable légale et êtes responsables de toutes dettes. C’est l’une des formes de structure idéale pour débuter.


 

Le statut de travailleur indépendant

Il s’agit d’un statut de société simplifié pour un individu, un partenariat ou un « trust ». L’activité doit être une activité commerciale relative à la production de produits ou à la prestation de services pour un prix négocié et convenu.

En général un travailleur indépendant :

  • Travaille pour obtenir un résultat
  • Fournis les équipements et les moyens pour accomplir le job
  • Est libre de sous-traiter
  • Est libre d’organiser son travail comme il l’entend
  • Fournis des prestations de services pour d’autres entreprises ou des particuliers
  • Est libre de d’accepter ou de refuser des contrats et est dans une position commerciale en vue de faire des profits.

 

Comment obtenir un ABN ?

C’est assez simple, vous devez en faire la demande en ligne, sur le site de l’Australian Taxation Office (ATO). Pour vous connecter, clicquez ici !

  • Pour faire une demande vous aurez besoin de votre numéro identifiant de taxes : TFN (Tax File Number).
  • Vous devrez aussi fournir votre adresse courante, vos coordonnées ainsi que celles de votre société.

Step 16: Once your application has been submitted you will receive a reference number. It is important to write this down. The ATO will then be in contact with you if they require more information or will email or post out your ABN certificate.

Risks/Obligations of being an independent contractor.

Self-employment involves some risks and responsibilities that employees typically don’t assume. For example, the independent contactor assumes all responsibility for tax obligations, handles his/her own benefits, manages billing and collections; maintains appropriate licensing and insurance, and accepts legal responsibilities and exposure associated with performing the job.

Tax obligations.

Goods and Services Tax (GST)

As an independent contractor you will probably need to register for GST. It’s applied to most goods and services sold or consumed in Australia, so it’s likely your service will be subject to GST.

Personal Services Income (PSI)

If you operate as a sole trader, you are entitled to claim certain expenses as tax deductions necessary to earn your income.

For example:

–          Tools

–          Petrol

–          Products used to complete the task/job.

–          Safety equipment

If you operate as a partnership, the partnership is entitled to claim certain expenses as tax deductions that are necessary to earn the partnership income. Each partner must pay tax based on net income. The PSI rules may affect the allocation of income and expenses between partners.

Tax must be paid on everything you earn otherwise you may find yourself in serious trouble with the ATO.

The Independent contractor is usually accountable for satisfying specific performances & expectations, including delivering customer service. Your agreement as an independent should clearly define how you should handle any customer related compaints.

 

Am I protected by the same employment laws as an employee?

In general, independent contractors are not protected by employment laws since they are self-employed. (The area of employment law is very complicated, and laws vary by state; questions about specific situations should be addressed to legal counsel.)

 

How will I be paid?

Reputable organizations typically disclose the terms and conditions of payment through a written compensation agreement. If commission is involved, the agreement should indicate whether the contractor is paid on a commission-only basis, draw vs. commission, or combination of base fee plus commission. The agreement will also describe how and when payment will be made. The terms of each applicable pay structure should be spelled out clearly in writing and agreed to by all parties before work is performed. The agreement should also clearly explain how payment disputes are settled. (Note: Remedies are available to independent contractors should a dispute involving payment for services arise. As independent contractors are self-employed, any dispute involving payment would be resolved either independently or with the help of dispute resolution services, such as collection services, mediation, or arbitration.) As with any agreement, you should seek advice and counsel from a trusted professional before signing and sign only when you fully understand what you are agreeing to.
