Do I need to leave Australia after my working holiday?

This question seems to be a very common question that working holiday makers ask when their Working Holiday Visa is about to expire and they want to apply for another visa.

The answer to this question is that you might need to apply offshore, or you may be eligible to apply for a new visa in Australia.

To check to see if you will need apply outside Australia you must check your visa conditions and also see if the visa that you are on a suitable visa to apply for another visa.

This can be done online using the  Visa Entitlement Verification Online (VEVO) system. To be able to do this, you will need to have:

  • passport number
  • date of birth
  • nationality and
  • visa grant or evidence number. (Your visa grant or evidence number will be in the visa label in your passport, or will be emailed through to you when you first apply for the visa)

There are two different types of working holiday visas. The subclass 462 working holiday visa and the subclass 417 working holiday visa.

If you are on a working holiday subclass 462 visa (the countries listed below), you will generally have to leave Australia to apply for a student visa.

  • Uruguay

 

If you are currently on a working holiday subclass 417 visa (countries listed below), you can usually apply from within Australia for a student visa.

  • Hong Kong
  • Ireland
  • Italy
  • Japan
  • Republic of Korea
  • Malta

Visa Conditions

When you log onto VEVO you will be able to view what conditions are placed on your visa. When you initially apply for your visa it is the discretion of the caseworker if they want to place a condition that you cannot apply for another visa inside Australia. This condition is called condition 8503.

Condition 8503

This conditions restricts the visa holder from applying for another visa (other than a protection visa) while in Australia. If this condition is imposed on your visa, you will need to go overseas to apply for another visa. If you do have this condition, I could think of no better time for a little vacation to Bali or NZ.
